By using the Business Reality Diagnostic at uxstrategist.org, you agree to these Terms. This service provides an interpretive diagnostic tool to support your business decision-making – not professional advice.

  1. The Diagnostic Service

    We analyse your assessment responses to calculate your Continuity Score and Sunk Cost Intensity, which are used to generate your Reality Report. This is a structural pattern-recognition tool – not a guarantee of business outcomes.

  2. Your Responsibilities

    • You confirm you are 18+ and operating or exploring a business venture
    • You provide accurate answers during assessment
    • You interpret and act on report insights at your own discretion

  3. Intellectual Property & Licensing

    The assessment methodology, scoring logic, and report templates are our proprietary intellectual property. You receive a single-user licence to your Reality Report for personal business decisions. You may not resell, redistribute, copy, or reverse-engineer our methodology or system architecture.

  4. Pricing, Taxes & 14-Day Structural Guarantee

    4.1. Pricing & Taxes: All prices are displayed in USD. As a Malaysian-based service, we do not charge SST unless your purchase exceeds local thresholds. International customers are responsible for any local "Use Tax" or duties applicable in their jurisdiction.

    4.2. 100% Return Commitment: We believe in 100% refund integrity. While standard payment processing fees are typically non-refundable, UX Strategist covers these costs internally (~$1.08 USD) to ensure you are made whole.

    4.3. The Guarantee: We offer a 14-Day Structural Guarantee. If you review the Reality Report and apply the Operational Math (defined as the relationship between the Continuity Score and Sunk Cost Risk as detailed in Sections 1 and 2 of the report) and it doesn't provide a clear path to reclaiming your leverage, you may request a refund within 14 days.

    4.4. Protection Against Fraud: To protect our IP, we reserve the right to deny refunds if we detect:

    • Immediate Reversal: Requests made within two (2) hours of delivery without a specific explanation of why the "Operational Math" failed your use case.
    • Data Harvesting: Clear intent to scrape proprietary diagnostic logic.
    • Serial Refunding: Strictly limited to one refund per customer (verified by email, IP, and payment identifier).

    By completing payment, you acknowledge immediate digital delivery and waive the standard cooling-off period under Malaysian consumer regulations for digital goods.

  5. Limitation of Liability

    To the extent permitted by Malaysian law, our liability for any claim related to this service is limited to the amount you paid ($27 USD). We are not liable for business decisions, lost revenue, or consequential damages resulting from your use of the diagnostic.

  6. Governing Law

    These Terms are governed by Malaysian law. Disputes are subject to the exclusive jurisdiction of the Malaysian courts.
